Machinist files suit for age discrimination

Ask around the motor repair service industry- most people will tell you their trusted winders and machinists have been at it for 20, 35, 50 years. It’s not only common- it’s a majority of the workforce. One of the chief concerns of motor shops everywhere is finding skilled young workers to pass the skills on to before the old guard- those who repaired motors in the prime of the mid-century- have left us.

So it’s striking to see a skilled machinist take his case to court after being fired from a West Virginia armature shop. Donald E. Jones of Logan County filed a complaint Jan. 30 in Logan Circuit Court against White Armature Works Inc., alleging violation of the West Virginia Human Rights Act.

According to the complaint, in February 2016, Jones, 74,  was laid off even although his lawsuit says he performed his duties in a satisfactory manner and met reasonable expectations. As a result, the suit says, Jones suffered lost wages and benefits, damages and humiliation.

The plaintiff alleges his supervisor, Rodney Amburgey, promised him that he would be brought back when business picked up, but Jones believes he was replaced by a younger and less-experienced worker.

Jones seeks trial by jury, all damages, including lost wages and benefits, back and front pay, all remedies afforded under the WVHRA, attorney fees and court costs and all other proper relief. He is represented by attorneys Todd S. Bailess and Rodney A. Smith of Bailess Smith PLLC in Charleston, Logan Circuit Court Case number 17-C-44-OB.

Electrical Apparatus was unable to obtain a comment from White Armature.
